Charges Laid Against Suncor Energy Inc. in Relation to Injured Worker on Terra Nova FPSO in December 2019 Incident

On December 15, 2022 the Canada-Newfoundland and Labrador Offshore Petroleum Board laid the following charges against Suncor Energy Inc. (Suncor) in relation to alleged offences related to an injury onboard the Terra Nova FPSO:

  1. On or about December 29, 2019, at or near the Terra Nova FPSO, in the Exclusive Economic Zone of Canada, in the offshore area off the Coast of Newfoundland and Labrador, whilst having been appointed under s. 160(1) of the Canada-Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations, Suncor failed to produce a signed written report that complied with s. 160(2) of said regulations, thereby committing an offence pursuant to paragraph 205.104(1)(a) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation Act C 1987, c.3.
  2. On or about December 29, 2019, at or near the Terra Nova FPSO, in the Exclusive Economic Zone of Canada, in the offshore area off the Coast of Newfoundland and Labrador, being unable to comply with 160(1)(a), (c), (e) and (f) of the Canada-Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations, Suncor did not ensure that every employee entering into, exiting from and occupying a confined space wore a safety harness that was securely attached to a lifeline, that was attached to a secure anchor outside the confined space, contrary to subsection 161 of said regulations, thereby committing an offence pursuant to paragraph 205.104(1)(a) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation ActC 1987, c.3.
  3. On or about December 29, 2019, at or near the Terra Nova FPSO, in the Exclusive Economic Zone of Canada, in the offshore area off the Coast of Newfoundland and Labrador, Suncor did not ensure that every employee entering into, exiting from and occupying a confined space followed the procedures and used the protection equipment as referred to in the written report required by section 160(2) of the Canada-Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations, contrary to subsection 160(6) of said regulations, thereby committing an offence pursuant to paragraph 205.104(1)(a) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation ActC 1987, c.3.

The first appearance is scheduled for January 25, 2023 at Provincial Court in St. John’s.

As this matter is before the courts, the C-NLOPB will not be commenting further at this time.
